The Led Zeppelin classic "Stairway To Heaven" has been the focus of copyright infringement claims since July 2014, forcing the band later that year to confront claims they stole its biggest hit from Randy Craig Wolfe, founding member of the band Spirit.

what a load of crap. He never heard it? They opened for Spirit in 1968 several times and even covered spirit's, Fresh Garbage, later on the tour. If they heard Fresh Garbage they must have heard at least one show on the tour. Spirit played Tarkus at those shows. Please I agree this is a bit late for a lawsuit but don't give me this I never heard the album or the tune before. please!

Led Zeppelin's Page And Plant To Face Jury Over Stairway To Heaven.

A US judge has ruled that Led Zeppelin guitarist Jimmy Page and singer Robert Plant must face a jury over claims that parts of Stairway To Heaven were copied from another song.

The estate of Spirit guitarist Randy California raised a lawsuit two years ago, stating that the band's 1967 instrumental Taurus was the source of the opening sequence from Zeppelin's 1971 classic.

California had said in interviews before his 1997 death that he had no doubt his work had been copied. But Page last year dismissed the suggestion as "ridiculous," and in February declared that he'd never listened to Taurus until confronted with the lawsuit.

Michael Skidmore, representing California's estate, said that Page could have heard the piece while the two bands toured the US together in 1968 and 1969.

Led Zeppelin's legal defense has not been based on the alleged similarity between songs, but on whether the Spirit party have any right to act over the matter. It's argued that California wrote Taurus under a contract that surrendered all rights to his work, and that he dismissed any claim in a 1991 interview in which he said: "I'll let them have the beginning of Taurus for their song without a lawsuit."

Led Zeppelin further argue that the chord progression at the core of the argument is so well-used that it doesn't warrant legal protection. However, Central District of California Judge Gary Klausner has ruled that the pieces are similar enough to let a jury decide whether Plant and Page are liable for copyright infringement, while dismissing claims against bassist John Paul Jones and the band's record label.

So basically Jimmy Page and Robert Plant are indeed admitting to plagiarizing the Spirit number.

Surprising that we're seeing this in the US now. I thought the statute of limitations was far passed, which is why they had to do it in Australia or wherever. I wonder what changed?

Led Zeppelin's Page and Plant Unlikely To Appear At Stairway Trial

Led Zeppelin men Jimmy Page and Robert Plant are unlikely to appear in court to answer copyright charges over classic track Stairway To Heaven, because the judge may not have the authority to make them do so.

And the band have successfully argued for the repression of evidence that was to be used against them when the jury trial begins in California on May 10. The legal action centers on whether Led Zeppelin plagiarized 1967 Spirit track Taurus in the opening section of Stairway, which was released four years later and followed the bands touring the US together.

Page and Plant have both recorded depositions that will be presented to the court, assuming that no settlement is reached before the case commences next month. Bandmate John Paul Jones was excluded from the case during Klausner's pre-trial ruling.

Lawyers representing the estate of late Spirit guitarist Randy California this week submitted a list of various Taurus recordings that they believe reinforce their position.

But District Judge Gary Klausner has agreed that the only recordings to be heard are those taken directly from the copyrighted sheet music.
